THE BORDER REPORT

Well here’s a move we didn’t predict: It appears that first came the gun, then came the rocks.

A cellphone video obtained by Univsion shows a U.S. Border Patrol agent drawing his weapon to keep two Mexican nationals from fleeing back to Mexico, an escalation that puts last Monday’s killing of a teenage boy nicely in context.

The Americans were quick to inform the media last night that the dead kid, Sergio Hernandez, was a known migrant smuggler, a tactic that suggests a bit of desperation on the their part. And I think we’re beginning to see why.

The agent draws his weapon at about 0:55 in the video as two Mexican nationals were running back south of the line. He rode up on his bike, intercepted the two and had his weapon out, reaching with one hand to grab one of the suspects by the arm.

Border Patrol agents are not supposed to draw their weapons unless they are under threat. If El Paso agents have been pulling weapons indiscriminately like this regularly, it goes a long way toward explaining why the Mexican cops had their own weapons out and pointed at the Border Patrol agents, a move that the Americans were also quick to point out.

I’m working on getting the agency’s weapons protocols and will post when I receive them.

You know how many border patrol agents have almost died from being hit in the heads w/ rocks….the criminal 15 yr old human smugler who has a crime list a mile long continued to try & kill the agent after repeated warnings…the criminal chose to continue to assault the agent..he & his buddies were pelting the agent from 3 different angels……38,000 Americans are killed from illegal aliens every year ( robbery, dui’s etc )…..Calderon condems the assaulted agent protecting himself but says nothing about the 38,000 Americans being killed by illegals each year……what a fake……In the USA you do not assault Federal Agents……

    1. You’ll need to post the medical documentation of all the agents that have nearly died by rocks.
    2. You’ll need to post the court records of all the convictions against this 15 year old’s long list of crimes.
    3. Where does the 38,000 number come from

  3. In the actual video, without the newscasters voiceover, the woman recording the events can be heard saying, “Theý’re throwing rocks”, and “They hit him”. This all occurs BEFORE the CBO fires his weapon. He did not pull his weapon to kept the illegals from fleeing back to Mexico, his weapon was pointed at the kids throwing rocks.

How did you manage to get the story so screwed up when it clear on the video?

  4. save yourself from being embarrased but the stupidity of your comment, when the woman said “they hit him” she’s talking about the kid being hit by the agent.

  5. What is this world coming to?
If the Border Agent would have just waited for backup.
the kids clearly had nothing on their person, they were just running back to the mexican side.
he did not need to take his gun out and point it in their faces.
im not sure but i even catch a hint of the BP agent kicking the kid as he is being dragged along, anyone else notice that?

  6. and what’s all this noise the u.s feds are making about the two thousand “narcos” they captured, is that a sequel to the whole “cartel” they captured in Arizona a couple of months ago?

    NO!
It’s all part of Chapo’s masterplan of taking over Juarez, he got infighting going on with La Linea and he promised people a change, so when one of them gets busted he tells them to rat out only the activities of La Linea and not his organization, and since there are rats on both sides and all of the main middle players are out he starts to eliminate the ex-Linea’s when they realize that what they were promised turned out to be bullshit, once the opposition is weak and “Gente Nueva” infight to weaken eachother he then puts his “Trusted People” in place, now that the DEA takes down the scraps………

  8. I am kind of divided on this one.
    1. If Sergio Hernandez was a Pookie G from the block and his boys throwin rocks at the local police nobody would give a ratz azz if Sgt. Hothead shot him and killed him it happens all the time in our inner cities a friend of mine got killed for cell phone.
    2. What was he doing trying to cross the border?
    3. What was the reason for provocing the BP agents??
    4. Where they having fun with them or was he commiting a crime??
    5. Was he smuggling people across the border right in front of the BP agents?
    6. I doubt that a known smuggler that knows the ropes would be smuggling ilegals threw one of the hottest parts on the border.
    7. Does he have some kind of criminal record that suggest he was a known smuggler or is he being slandered by the American media?
    8. What does shooting across international borders mean for a federal agent is it somthing that is allowed?
    9. How big of a threat are 14 year olds with rocks?
    10. Why was the girl recording with her cell phone?
    11. What is the name of the agent who shot this kid and what is his backround? Any internal dirty stuff about him?

    [Reply]

  9. A lot of great questions you have pointed out

  10. sadly nothing new here…you guys remember Michael Elmer who shot a Mexican in the back, dragged him into a ditch, buried him still alive and threatened to kill his partner if he talked. He was acquitted.

  11. The video is poor, but I believe the agent drew something twice from a holster. I suspect a taser was drawn first then a gun when the rocks came. Hard to tell with the video but why put the gun away and then draw it again if you are just a rogue agent shooting illegally?

    [Reply]

    Michel Reply:

El Paso Sector’s bike agents don’t carry Tasers, so the only other possibility is pepper-spray, but the object in hand looks elongated horizontally, not vertically. I’m fairly certain that’s a gun in his hand.

Regarding your comment, does it have to do with the following article (courtesy of the Chicago Tribune): “9 charged in massive drug bust”

Nine people were charged in connection with the seizure of more than 40 kilograms of heroin, primarily in Chicago, and eight kilograms of cocaine as part of Project Deliverance, an investigation into Mexican drug-trafficking organizations that operate in the United States, federal authorities said Thursday.

The nine defendants were among 2,200 people charged with narcotics-related offenses across the country as part of the nearly two-year investigation — conducted by the U.S. Drug Enforcement Administration, U.S. Immigration and Customs Enforcement and FBI — that led to the seizure of more than 74 tons of illegal drugs.

During the Chicago investigation in which the nine people were charged, 44 kilograms of heroin was seized, most of it on May 28, along with the eight kilograms of cocaine, tens of thousands of dollars and a handgun, federal authorities said.

One complaint charges one of the those defendants, 23-year-old Antonio Figueroa, also known as “Gordo,” of Chicago, with conspiracy to possess and distribute 37 kilograms of heroin that was seized. He was arrested, federal authorities say, after he took possession of a small truck used to transport the heroin from a person he met in a pharmacy parking lot at Armitage and Keeler avenues.

  13. It’s disgusting how the agent murdered that child in cold blood. But what I find more disgusting is that the puppet and stooge Calderon still thinks these people are his allies. Even with Mexico on the brink of civil war and the deaths of 2 of his citizens at the hands of American security forces, the dictator still continues his World Cup trip.

ILLEGAL MEANS AGAINST THE LAW. COME HERE LEGALLY, IF YOUR HERE ILLEGALLY GET THE FEK OUT>! WHATS THE MEXICANS IMMIGRATION LAW?? PRISON IF YOUR CAUGHT.
OFF TOPIC, We have a war on terror? If there is a known murdering wacko in your neighborhood do you leave your front door open??
Put the troops and .50 AUTO machine gun turrets every 500 yards. After a few FOOLS try to cross and get killed maybe they will think twice or maybe not. This is an INVASION OF OUR NATION. WAKE THE FEK UP.

  17. The “Agent Drew First” is of no importance. As far as police on duty are concerned, “pointing a firearm without firing it or making any attempt to fire it is not in itself the use of deadly force.”

And in case anyone had questions about why the B.P. agent didn’t just let the arrested guy go and back off:
“The officer has no duty to retreat as the force escalates, and if the force should ratchet up to the point where the suspect threatens the officer with death or serious bodily harm, the officer may use deadly force to retain custody (LaFave and Scott, sec. 5.10). ”
